This is an application against the order, dated 13.04.2018, passed by the Special Judge, Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Saran at Chapra, in Revilganj P.S. Case No. 74 of 2018 registered for offences under Sections 341, 323, 324, 379 and 504/34 of the Indian Penal Code and 3(I)(r) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, whereby and whereunder the prayer for regular bail of the appellant has been rejected.
Counsel for the appellant submits that the instant case has been filed merely as a defence of Revilganj P.S. Case No. No. 73 of 2018 filed by the father of this appellant against the
Patna High Court CR. APP (SJ) No.1493 of 2018(3) dt.23-05-2018 2/2 informant and others. In the instant case there is allegation against the appellant that he caused injury to the informant with daab on his neck and other part of the body. The injury report has been annexed as Annexure 3, which shows that the informant has sustained simple injury.
Considering the entire facts and circumstances, aforesaid, let the appellant, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Revilganj P.S. Case No. 74 of 2018 to the satisfaction of the Special Judge, Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Saran at Chapra. (Sanjay Priya, J) Shamshad/- U T
