2. The petitioner seeks bail in connection with Hajipur Town P.S. Case No. 708 of 2023 registered for the offences under Sections 302 and 34 of the Indian Penal Code & Section 27 of the Arms Act.
3. The petitioner is not named in the F.I.R. and is in custody since 13.11.2024.
4. As per FIR, some unknown persons committed murder of the nephew of the informant after calling him near to R.N. College, Hajipur.
5. Mr. Anshul, learned senior counsel appearing on
Patna High Court CR. MISC. No.41365 of 2025(2) dt.20-08-2025 2/3 behalf of the petitioner submitted that name of petitioner transpired in the present case during the investigation out of confessional statement of co-accused Chanchal Kumar Sah, where he confessed that this petitioner supplied mobile number of deceased. It is submitted that aforesaid confession was recorded in police custody and as petitioner found involved in four more criminal cases, out of said suspicion police falsely implicated him with present crime in question. It is also pointed out that on the basis of said confessional statement 14 persons were made accused in this case, where in furtherance of said confession nothing incriminating recovered/surfaced, so as to connect this petitioner with the present crime in question. While concluding the argument it is submitted that investigation of this case has already completed, and as such, there is no chance of tampering with the evidence.
6. Learned APP appearing on behalf of the State, opposes the prayer for bail.
7. In view of aforesaid factual submission and by taking note of fact as save and except suspicion arising out

No.41365 of 2025(2) dt.20-08-2025 3/3 confessional statement of co-accused Chanchal Kumar Sah nothing prima-facie appears incriminating against this petitioner as to connect him with the present occurrence, coupled with the fact as petitioner remains in custody since 13.11.2024, accordingly above named petitioner, is directed to be released on bail in connection with Hajipur Town P.S. Case No. 708 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive A.D.J.-IX, Vaishali at Hajipur/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
