The petitioner has prayed for bail in connection with Amba P.S. Case No. 36 of 2019 registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016. As per the allegations in the FIR, 235 liters country made liquor was recovered from a car. It is further stated that two persons i.e. petitioner and one Bajrangi Kumar Sharma were sitting on that car and on query they did not satisfactorily reply regarding vehicle or the liquor.

It is submitted by the learned counsel for the petitioner that petitioner is neither the owner of the vehicle nor has any concern with the seized liquor. It is further stated that co-accused Bajrangi Kumar Sharma has already been allowed

Patna High Court CR. MISC. No.38105 of 2019(2) dt.05-07-2019 2/2 bail vide order dated 04.06.2017 passed in Cri. Misc. No. 35967 of 2019. He has no criminal antecedent and he is in custody since 22.04.2019.

Having heard the learned counsel for the parties and considering the fact that co-accused Bajrangi Kumar Sharma has already been allowed bail, this Court is inclined to grant bail to the petitioner. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VII-cum-Speical Judge (Excise), Aurangabad in connection with Amba P.S. Case No. 36 of 2019.
