JUSTICE SUDHIR SINGH ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25(1-B) a, 26 and 35 of the Arms Act. Allegation, according to informant, who is a police officer, is that while they were checking vehicles petitioner along with two other persons were arrested and on search, from possession of petitioner arms were recovered. It has been submitted on behalf of the petitioner that he is in custody since 12.5.2016. Chargesheet has been submitted against the petitioner. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner.

One loaded pistol with two cartridges and separately two more cartridges are said to have been recovered from the possession of petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure. Vide Annexure-3 to the supplementary affidavit other co-accused has been granted bail. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.33649 of 2016 (3) dt.26-09-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Birpur, District-Supaul, in connection with Karjain P.S. Case no. 42 of 2016.
