The petitioner seeks bail in Khaira P.S. case No. 233 of 2015 under Section 366A/34 of the Indian Penal Code. The father of the victim alleged that petitioner enticed away his minor daughter for the purpose of marriage. The learned counsel for the petitioner submits that victim came and made her statement under Section 164 of the Cr. P. C. The victim disclosed her age to be 17 years. From the perusal of the statement of the victim, it appears that the victim went along with the petitioner to Ranchi with her consent. She moved all along with the petitioner but she did not raise any alarm nor complained about her kidnapping. The doctor assessed the age of victim about 18 years.

Patna High Court Cr.Misc. No.9369 of 2017 (3) dt.12-04-2017 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in Khaira P.S. Case No. 233 of 2015.
