This is an application for bail in connection with Rail Amour P.S.Case No. 207 of 2015 registered for the offences punishable under Sections 376/34 of the Indian Penal. It has been submitted on behalf of the petitioner that marriage of the petitioner with the victim girl has been solemnized and petitioner is ready to keep her. However, petitioner is in custody since 14.6.2016.

Heard learned APP also, who has opposed the prayer for bail stating that there is direct allegation against the petitioner. Having heard both sides and considering the nature of allegation, I am not inclined to grant bail to the petitioner. However, if such a petition is filed before the learned

Patna High Court Cr.Misc. No.7822 of 2017 (2) dt.22-02-2017 2/2 court below that petitioner has married the victim girl and they are ready to live together, learned court below will consider the same after calling the victim girl and pass appropriate order without being prejudiced by this order.

With the aforesaid observations, this application is dismissed.
