2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Amnour P.S. Case No. 22/2025 registered for the offences punishable under Sections 331(6), 103(1) and 61(2) of the BNS.

3. As per FIR, petitioner along with other named coaccused persons alleged to commit murder of the son of informant.

4. It is submitted by learned counsel appearing on behalf of the petitioner that informant is not the eye-witness of the actual occurrence and mere on the basis of suspicion petitioner was implicated with the present crime in question. It is submitted that allegation of assault is appearing very much general and omnibus in nature. It is further pointed out that admittedly there was enimical terms of informant with petitioner and other named co-accused persons as daughter of informant

Patna High Court CR. MISC. No.40808 of 2026(2) dt.24-06-2026 2/2 was in love affair with the one of the co-accused persons and as said relationship was not approved, hence present false implication was raised against this petitioner. Petitioner claimed clean antecedent.

5. Learned APP while opposing the prayer of bail submitted that petitioner along with other co-accused persons took liquor in the evening of 30.01.2025 together with deceased and drop him at his residence. It is pointed that after sometime all accused persons including petitioner again came to his home and took him to roof of the house and started assaulting son of informant with knife, after hearing noise, informant went to the roof and saw accused persons after committing murder of his son, petitioner and other accused were escaping using drainage pipe.

6. In view of aforesaid factual submission and by taking note of fact as petitioner found actively involved in committing murder of the son of the informant as discussed aforesaid, accordingly prayer of anticipatory bail of petitioner stands rejected.
