The petitioner seeks regular bail in connection with Patliputra PS case no. 33 of 2018 instituted for the offences punishable under Sections 379, 414, 411 of Indian Penal Code. The allegation is regarding one co-accused person namely Krishna @ Kanhaiya Kumar having been apprehended from the spot with a stolen motorcycle and he is said to have disclosed the name of the petitioner and other accused persons. The learned counsel for the petitioner submits that neither any recovery has been made from the conscious possession of the petitioner nor the petitioner has been apprehended from the spot. Patna High Court Cr.Misc. No.26290 of 2018 (3) dt.30-05-2018 2/2 persons have already been granted bail by the learned trial court. Lastly, it is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 31.01.2018. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sub Judge XII-cum-ACJM, Patna in connection with Patliputra PS case no. 33 of 2018.
