JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302, 201, 323, 504 and 304 of the Indian Penal Code.

It is alleged by the informant that on the date of occurrence accused Brahmadeo Sah came to her house and went with her husband for taking meat, till night when he did not return then the informant went to the petitioner and during the course of search she found that the towel of her husband in a wheat field which was with sign of blood.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. As per the allegation, it is the co-accused Brahmadeo Sah who is said to have

The name of the petitioner has come merely on the basis of suspicion, except for the same there is no other material to suggest his implication in the present case. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari, East Champaran in connection with Muffasil P.S.Case No.66 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
