The petitioner is an accused in connection with Chiraiya P.S. Case No. 158 of 2016, registered under Sections 304-B/34 of Indian Penal Code, pending in the Court of SDJM, Sikarahana at Dhaka, East Champaran.
The accusation is of killing of the daughter of the informant by her husband and other in-laws due to non-fulfillment of demand of dowry.
Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner was out of village on the date of occurrence and his wife committed suicide due to family dispute. Further submission is that the occurrence took place after seven years of marriage of the deceased. Further submission is that in the post-
Patna High Court Cr.Misc. No.6743 of 2017 (3) dt.22-03-2017 2/2 mortem report the cause of death was shown as asphyxia as a result of hanging (suicide). Further submission is that petitioner is in custody since 20.08.2016.
Learned counsel for the State vehemently opposed the prayer of the petitioner.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected.
