The petitioner seeks regular bail in connection with Bhagwanpur P.S. Case No.173 of 2017 for the offences punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
Allegation of the prosecution is that there is recovery of 1337 litres of illicit liquor from a Bolero vehicle. The learned counsel for the petitioner submits that the petitioner is neither the owner nor the driver of the said vehicle and has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 18.03.2018.
Having regard to the facts and circumstances of the case,
Patna High Court Cr.Misc. No.29104 of 2018 (3) dt.21-05-2018 2/2 the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No.173 of 2017.
