JUSTICE SANDEEP KUMAR ORAL ORDER 17-11-2021 Petitioner is apprehending arrest in connection with Raniganj P.S. Case No. 252 of 2019 for the offence under section 366(A)/34 of the Indian Penal Code.

This case has been registered on 30.7.2019 i.e. more than two years before. There is no impugned order of date of arrest in the present case. The petitioner has no apprehension of arrest. Therefore, the application for anticipatory bail is held to be premature.

Heard the parties.

However, learned counsel for the petitioner is insisting that his submission to be recorded on merit despite this Court has observed that this application is premature and therefore, the

Learned counsel for the petitioner submits that there is no allegation against the petitioner in the statement recorded under section 164 Cr.P.C. and on that ground he prays for anticipatory bail.

In the opinion of this Court, the present application for anticipatory bail is not maintainable as there is no apprehension of arrest, therefore, it is dismissed. (Sandeep Kumar, J) Ravi/- U T
