JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47(a) of Excise Act. Near about ten litres country made Nepali liquor is said to have been recovered from possession of the petitioner while he was carrying the same on the bicycle from Nepal. Petitioner is in jail custody since 05.06.2016 and does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.36449 of 2016 (3) dt.05-09-2016 2/2 two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with G.O. No. 39/16.
