The petitioner apprehends his arrest in Delha P.S. Case No.257 of 2020, registered for the offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner along with other co-accused persons is said to have fired upon the informant which hit in her left thigh. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that there is general and omnibus allegation against the petitioner. It is further submitted that the petitioner has got no criminal antecedent as stated in para 3 of the bail application.
Patna High Court CR. MISC. No.49537 of 2021(3) dt.20-06-2022 2/2 Learned APP for the State opposes the prayer for anticipatory bail of the petitioner and submits that the injury is grievous in nature. The petitioner is absconding in the present case. Charge sheet has been submitted against other co-accused persons and investigation is going on against the petitioner. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
