1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 447, 337, 338, 323, 504, 506, 34 of the Indian Penal Code & Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant, who alleges that there is a huge sewage canal from Mirchaiya Tola to Ganga Colony and the said canal is used for carrying out illegal sale of liquor, on which, the local people raised objection when they were threatened of dire consequences, thereafter, on 26.03.2024 the accused persons along with 20-25 unknown came to the locality and started pelting bricks and fired several round in the air, thereafter, the police was informed, who chased the miscreants.

No.44164 of 2024(2) dt.07-08-2024 2/2 The learned counsel submits that from perusal of the allegation, as alleged in the F.I.R., it would manifest that the allegation against the accused persons is general and omnibus in nature. It is also submitted that the petitioner is a vegetable seller and he used to install his kiosk, which was objected by the local people of the locality, as such, he also came to be implicated. It is also submitted that petitioner will not abscond rather will co-operate in the investigation and is a person with clean antecedent.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Alamganj P.S. Case No.273/2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) amit/- U T
