JUSTICE SANJAY PRIYA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sessions Case No. 23/16, arising out of Kajra P.S. Case No. 49/15 instituted for the offence under Section 302/34 of the Indian Penal Code. The petitioner is said to be main assailant. He assaulted the husband of the informant with 'Kulhari' causing injury on head and neck. He died in PMCH in course of treatment. A report was called for from the court below wherein it has been mentioned that the trial is likely to be concluded within six months.
The petitioner is in custody since 29.9.2015. In such circumstances, at this stage, this court is not inclined to grant bail to the petitioner. Accordingly, prayer for bail
Patna High Court Cr.Misc. No.8100 of 2017 (3) dt.30-03-2017 2/2 of the petitioner is rejected.
The trial court is directed to make efforts to conclude the trial within six months as mentioned in the report by fixing the case on day-to-day basis and also instruct the S.P., Lakhisarai to get the witnesses produced in the case for speedy disposal within a period of six months.
The petitioner may renew prayer for bail after six months in the lower court itself, if trial is not concluded within six months.
The court below will give reason if the trial is not concluded with the period of six months. If the reason is not found satisfactory, necessary action will be taken against the trial court. (Sanjay Priya, J) Ravi/- U T
