2. The petitioners have preferred this application for grant of regular bail in connection with Maranga P.S. Case No. 16 of 2025 dated 17.01.2025 registered for the offences punishable u/ss 103, 303(2), 62 read with Section 3(5) of the B.N.S. and Section 27 of the Arms Act.
3. As per the prosecution case, on hearing the noise, the informant's father, Md. Rafik came out of the house and was urinating on the road side. Suddenly, two unknown persons riding on a motorcycle were passing. The informant's father asked them about the noise in the village, in the

No.38318 of 2025(3) dt.20-08-2025 2/3 meantime, a person sitting behind on the motorcycle fired from his gun which hit the informant's father causing injury on his left thigh due to which blood started oozing out and he fell down on the ground. The accused persons fled away from the spot. The informant's father was taken to the hospital and during the course of treatment, he died. It is further alleged that the accused persons had come to steal fertilizer from the godown of Mohamad Imran in Kakarjan village.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is general and omnibus allegation against the petitioners. The petitioners are not named in the F.I.R. The name of the petitioners has sprung up in the confessional statement of the one Suman Kumar Yadav. Nothing has been recovered from the conscious possession of the petitioners. The petitioners have no concern with the alleged offence. The petitioners have one criminal antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 20.03.2025.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.38318 of 2025(3) dt.20-08-2025 3/3 of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Purnea in connection with Maranga P.S. Case No. 16 of 2025 with the condition :- (i) The petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to be cancelled.
7. The application stands allowed.
