The petitioner seeks bail in a case instituted for the offence under Sections 302/201 of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner is in custody since 03.07.2015. His name has surfaced in the confessional statement of co-accused Kari Singh @ Rakesh Singh, as mentioned in para-36 of the case diary. Further Bechalu Mishra has been granted bail by Co-ordinate Bench of this Court vide Cr. Misc. No. 22380 of 2016.

From perusal of the written report, it appears that the informant got information from the villagers that a dead body of his cousin brother is lying in the field of Chandrachur Singh. The informant went there and saw the dead body of Mukesh Kumar,

Patna High Court Cr.Misc. No.3721 of 2017 (2) dt.09-02-2017 2/2 who was murdered by throttling and leg and hands were tied with rope. The Additional Sessions Judge-VI, Begusarai has mentioned in his impugned order that the name of this petitioner has come in confessional statement of co-accused Kari Singh @ Rakesh Singh, in para-36 of the case diary.

It has been submitted on behalf of the State that trial has also begun. The learned counsel for the petitioner has no information about the latest stage of the case. Be that as it may, since the petitioner is in custody since 03.07.2015, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI, Begusarai, in connection with Begusarai Muffasil (Singhaul) P.S. Case No. 47 of 2015, S.Tr. No. 261 of 2016.

The petitioner is directed to remain physically present in the court below on each and every date till final disposal of the case. If the petitioner fails to appear on two subsequent dates, the court below will be at liberty to cancel the bail bond of petitioner. (Sanjay Priya, J) Amit/- U T
