JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------- 09-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioner seeks bail in connection with Hajipur Sadar P.S. Case No.411 of 2015 registered under Sections 326(A), 302 and 379/34 of the Indian Penal Code.

The accusation is that on 13.08.2015 at 12.00 noon, the husband of the informant with cash Rs.20,000/- had gone to Patna for purchasing house utensils. In the way, the three villagers, named in the F.I.R., including the petitioner, of the informant surrounded her husband and tried to snatch the money. On protest being made by the husband of the informant, they assaulted the husband of the informant and poured the acid on his body, as a result of which he died. At that

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the informant is not an eye witness to the occurrence rather the informant has stated that her son was present at the time of occurrence but he has not stated in his statement about chasing him by the petitioner and others. The petitioner having no criminal antecedent is in custody 05.08.2016. Further submission is that the similarly situated co-accused Dharam Ram has already been granted bail by this Court vide order dated 22.02.2016 passed in Criminal Misc. No.1123 of 2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No.411 of 2015.
