2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 103(1), 238 and 3(5) of the Bharatiya Nyaya Sanhita.
3. The case of the prosecution is that the husband of the informant, namely Shaheed has gone on a call on 24.02.2025.He did not return till 25.02.2025. On 26.02.2025, the son of the informant came to know that a dead body is lying in the field of Mohammad Moise and has suspected that five persons have killed his father.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.38188 of 2025(4) dt.02-09-2025 2/3 that the name of this petitioner is not there in the FIR. His name has surfaced on the basis of mobile tower location. Paragraphs 59 and 60 of the case diary shows that there was talk between Chandani and this petitioner and that the tower location of the petitioner was found in the place of the occurrence. After that confessional statement of this petitioner was recorded which is in Paragraph 73 of the case diary. After that, confessional statement of Chandani was also recorded in Paragraph 79 of the case diary. In her confessional statement she has stated that she and this petitioner along with other pressed the neck of the deceased. Learned counsel for the petitioner has submitted that except for the confessional statement there is nothing against the petitioner. The petitioner is a man of clean antecedent and is in judicial custody since 06.03.2025.
5. Learned counsel for the Informant has vehemently opposed the bail and has stated that tower location shows strong suspicion. He admits that there is only suspicion against the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with
Patna High Court CR. MISC. No.38188 of 2025(4) dt.02-09-2025 3/3 Amour P.S. Case No. 82 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea.
