JUSTICE SANJAY KUMAR ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

The petitioner seeks regular bail in connection with Singheshwar P.S. Case No. 222 of 2016 registered for the offences punishable under Sections 30(a) Bihar Prohibition and Excise Act, 2016.

The informant of this case is the Police Officer, who on secret information, conducted raid and seized 21 bottles of foreign liquor kept in a steel box in the garage of the petitioner. Learned counsel for the petitioner has denied the allegation of recovery of any foreign liquor from his possession or from the garage in question. The seizure was not made in presence of the petitioner, which is evident from the seizure list.

Patna High Court Cr.Misc. No.5630 of 2017 (2) dt.08-02-2017 2/2 Learned APP for the State, on the other hand, opposed the submission.

The petitioner is in custody since 05.11.2016 on the charge of recovery of 21 bottles of foreign liquor. The seizure list does not bear his signature. Having regarding to the facts and circumstance of this case, the prayer for bail application is allowed and the petitioner, Arvind Kumar Yadav, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S.
