JUSTICE SUDHIR SINGH ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 395 of the I.P.C.
The allegation against the accused persons including the petitioner is of looting Rs.1,24,600/- and five mobiles. It has been submitted on behalf of the petitioner that the petitioner is in custody since 7.5.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. There is no recovery of any incriminating article from the possession of the petitioner. In paragraphs 7, 8, 9 and 24 of the case diary it has come that the petitioner happened to be the employee of Informant. There was a
Patna High Court Cr.Misc. No.32535 of 2016 (3) dt.17-09-2016 2/2 dispute in respect to wage of the petitioner. Hence, he has falsely been implicated in the present case.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. case No.278 of 2016 (G.R.
