JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 15-02-2022 Heard the parties through video conferencing. Learned counsel for the petitioners submits that petitioner no. 3 has been arrested and he seeks permission to withdraw the application as against petitioner no. 3. Permission is granted.

The bail application of petitioner no. 3 is dismissed as withdrawn and is now restricted to petitioners no. 1 and 2 only. The petitioners no. 1 and 2 seek bail in anticipation of their arrest in connection with Industrial Area P.S. Case No. 51 of 2021 instituted for the offences punishable under Sections

Patna High Court CR. MISC. No.49867 of 2021(2) dt.15-02-2022 2/2 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that it is a case registered against other family members by the informant, relating to the property dispute and the names of the petitioners being also mentioned and there is no specific overt Act alleged against the petitioners.

Taking into consideration, I am inclined to allow the petitioners no. 1 and 2 on bail, in the event of arrest they shall be released on anticipatory bail, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
