The petitioner seeks bail in Kuraskanta P.S. case No. 10/2016 under Section 304B/34 of the Indian Penal Code. The informant, father of the deceased, alleged that his daughter was married to Nityanand Singh @ Nitish Kumar Singh, son of the petitioner, about 13 years ago. She also got two children but after marriage the husband and wife were not living well due to non fulfillment of demand of dowry and torture. Laxman Singh, the petitioner, informed the informant that there was mutual scuffle between husband and wife and immediately thereafter his daughter-in-law committed suicide. The informant went there but none of the family members were present.

The learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.35669 of 2016 (4) dt.17-11-2016 2/2 marriage was solemnized 13 years ago. The informant himself alleged that husband and wife were not living well although the deceased had two children one of eight years and another of five years. The petitioner is father-in-law of the deceased. No specific allegation is made against the petitioner. The petitioner is in jail since 16.02.2016.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Kumar Amit Manu, learned Additional Chief Judicial Magistrate-II, Araria in Kuraskanta P.S. Case No. 10 of 2016.
