2. The petitioner seeks bail in connection with Bairiya P.S. Case No. 107 of 2026 registered for the offence punishable under Sections 80(2) and 3(5) of the Bharatiya Nyaya Sanhita.
3. The petitioner is the husband of the deceased. He is alleged to have killed the deceased for demand of dowry.
4. The petitioner is in custody since 01.03.2026.
5. Learned counsel for the petitioner submits that from the FIR itself, it appears that the petitioner was not present in the house. It is further submitted that in the postmortem report, there is no external injury except for a ligature mark which shows that the deceased may have committed suicide.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
7. Considering the fact that from the reading of the FIR itself, it appears that the petitioner was not in his house on the date of occurrence and the fact that there is no external injury on the deceased except for a ligature mark, this application is allowed.
8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Bettiah, West Champaran/ Successor Court in connection with Bairiya P.S. Case No. 107 of 2026, subject to the condition that the petitioner will co-operate in the trial.
9. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
