JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 29-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. Learned counsel for the petitioner is directed to remove the defects, as pointed out by the office, within a period of four weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 302 & 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against this petitioner is that he was present with one Pawan Paswan who shot dead the son of the informant.

Patna High Court CR. MISC. No.50056 of 2021(2) dt.29-04-2022 2/3 It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case due to dirty village politics. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The specific allegation of shoting is against co-accused, Pawan Paswan. Neither the petitioner fired upon the son of the informant nor he had given order to do so. He was only the member of the mob. Petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Naya Ram Nagar P.S. Case No. 208 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
