JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-11-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner seeks regular bail in connection with Nasriganj P.S. Case No. 04 of 2022, registered for the offences punishable under Sections 504 and 506 of the Indian Penal Code and Section 66(c), 67(a) and 67(b) of the I.T. Act and Section 12 of the POCSO Act.

As per allegation, the petitioner and his mother Mala Devi and his sisters after misusing the ID of the daughter of the informant as well as his son Abhishek Raj, were uploading some objectionable photographs of the informant's daughter on social media and were threatening to kidnap her.

The learned counsel for the petitioner has submitted

As a matter of fact, there was love and affection between the petitioner and the daughter of the informant, but the marriage between them could not be materialized, which was the reason of the false implication of the petitioner, who is a person of clean antecedent and languishing in jail since 21.01.2022.

Considering the above-mentioned facts and circumstances, let the petitioner above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District Judge-VII-cum-Exclusive Special Court (POCSO), Sasaram in connection with Nasriganj P.S. Case No. 04 of 2022 subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make themselves available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
