JUSTICE SANJAY PRIYA ORAL ORDER 3/ 02-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State as well as counsel for the Informant. The Petitioner seeks bail in Bikram P.S. Case No.152 of 2016 instituted for the offence under Section(s) 364, 120-B, 302, 201/34 Indian Penal Code.
It is alleged that the son of the Informant, Shubham Kumar, had gone to meet Face-Book friend, Lovely Singh, and while he was going on Tempo with Lovely Singh, in the way, this petitioner and other two accused persons followed the Tempo with motorcycle, abused and also assaulted him. Thereafter, Saurabh Kumar, friend of Subham came on motorcycle and gave information to the informant.
Learned counsel for the informant has submitted that
Patna High Court Cr.Misc. No.3733 of 2017 (3) dt.02-03-2017 2/2 the statement of Saurabh has been recorded under Section 164 Cr. P.C., wherein, he has stated that this petitioner assaulted the son of the informant with Banshi.
The learned APP has opposed the prayer for bail. Learned counsel for the petitioner has submitted that in Post Mortem Examination Report no injury has been found and decomposed body was recovered. The petitioner is said to be in custody since 12.07.2016.
In the facts and circumstances of the case, prayer of the petitioner for bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Danapur, in connection with Bikram P.S. Case No.152 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
