JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-04-2023 Though the present writ petition has been filed for quashing the notice dated 04.07.2022, issued by the Circle Officer, Raxaul, District-East Champaran, in connection with Encroachment Case No. 04 of 2022-23, however, the respondents have filed a counter affidavit, wherein, the final order dated 04.07.2022, passed by the Circle Officer, Raxaul, under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in connection

Patna High Court CWJC No.10466 of 2022(2) dt.28-04-2023 2/2 with Encroachment Case No. 04 of 2022-23 has been annexed.

In view of the aforesaid, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to challenge the aforesaid order dated 04.07.2022, passed by the Circle Officer, Raxaul, by filing appropriate appeal. Liberty so sought is granted.

It is needless to state that for a period of four weeks from today, status quo existing as on today, qua the land/house of the petitioners in question shall be maintained, in order to enable them to file appropriate appeal and obtain interim orders.

The writ petition stands disposed off on the aforesaid terms.
