====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 22-05-2015 Heard learned counsel for the petitioner and the State.

Petitioner is a tempo driver. He is apprehending his arrest in connection with a case registered for the offence under Section 7 of the Essential Commodities Act as according to the prosecution story his tempo was being used for carriage of P.D.S. rice.

Petitioner being a tempo driver, his antecedent being clean, is directed to surrender in the court below within four weeks from the date of receipt/production of a copy of this order in the court below and thereafter be admitted to the

Patna High Court Cr.Misc. No.13757 of 2015 (2) dt.22-05-2015 2/2 privilege of bail on furnishing bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Belhar (Khesara) P.S. Case No. 160/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
