JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-11-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 399 and other ancillary sections of the Indian Penal Code, sections 25(1-B)a, 26 and 35 of the Arms Act and sections 20, 22, 24, 27(a) of the NDPS Act. Prosecution case is that 3.13 kilograms Ganja and some arms and ammunition were recovered from the possession of co-accused.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner's name has figured during course of investigation in confessional statement of co-accused. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.40846 of 2022(2) dt.28-11-2022 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I cum Special Judge, Vaishali at Hajipur in Vaishali (Belsar OP) Police Station Case No. 173/2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
