JUSTICE ARVIND SRIVASTAVA ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is accused in connection Korha P.S. Case No. 65 of 2016 registered under Sections 302 and 120B of the I.P.C and 27 of the Arms Act.

It is submitted that the petitioner has been falsely implicated in the present case. From the F.I.R it appears that the informant has only raised a suspicion against the petitioner that he had killed his brother. The paragraph 21 of the case diary shows that prior to the occurrence only altercation took place between the petitioner and the deceased. Also he is in custody since 29.11.2016.

Having considered the facts and circumstances of the

Patna High Court Cr.Misc. No.4927 of 2017 (3) dt.28-03-2017 2/2 case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Korha P.S. Case No. 65 of 2016.
