2. Petitioner seeks bail who is in custody since 06.04.2026 in connection with Dinara P.S. Case No. 150 of 2026 for the offences punishable under Sections 126(2), 115(2), 74, 109, 117(2), 351(2), 352, 3(5) of BNS.
3. That the prosecution case, in brief, is that on 05.04.2026 the aforesaid Dinara P.S. Case No. 150 of 2026 was lodged on the basis of written report of Birendra Kumar Singh, alleged therein that on 04.04.2026 at about 9.00 P.M. while he was going to tied their animal in the mean while his co-villager namely 1. Vimal Yadav, 2. Surendra Yadav, 3. Raju Yadav, 4. Bhola Yadav, 5. Lavkush Yadav, 6. Uttam Yadav, 7. Manti Devi,8. Mira devi, 9. Renu Kumari and 10. Mamta Devi, having
2/4 various arms in their respective hand attacked upon him. It is alleged that Bhola Yadav has gave farsa blow on his head, which caused injury on his head and he fell down on earth thereafter Raju Yadav and Uttam Yadav assaulted him by means of Lathi-Danta. On sound of quarrel when his wife namely Gulabi Devi and his brother namely Narendra Singh came there then accuse persons started assaulting them. It is alleged that Manti Devi, Mira Devi, Mamta Dev and Rinu Devi were pulling hear of his wife namely Gulabo Devi. It has further alleged that Raju Yadav having arms Kulhari (Axe) came there and Gulabo Devi assaulted to his wife resulting she received injury her head. It is further alleged that Lav-kush Yadav caused fracture injury on the hand of his wife. It is alleged that Raju Yadav caused injury on the head of his brother Narendra Singh by means of Axe, further detail has been given in the first information report.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. It is further submitted that the allegation as alleged in the FIR is forged and fabricated and the petitioner has not committed any offence as alleged in the FIR. It is further submitted that there is a case and counter-case between both the parties. It is next submitted that it appears from the FIR that due to some petty
3/4 dispute the present occurrence has taken place although the petitioner is named in the FIR but there is no specific allegation of assault or overt act attributed against the petitioner rather the allegations are general and omnibus in nature and the petitioner is in custody since 06.04.2026.
5. The learned Additional Public Prosecutor for State has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Bikramganj, Rohtas, Bihar in connection with Dinara P.S. Case No. 150 of 2026 subject to the following conditions:- i. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on her absence on two consecutive dates without sufficient reason, her bail bond shall be cancelled by the Court below. ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
