JUSTICE SANJAY PRIYA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in Bihariganj P.S. Case No.166 of 2016 instituted for the offence under Sections 376, 511, 323, 341, 324, 504 and 506/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner is implicated in this case on account of money dispute.

As per the written report, while the informant was going for call of nature, all of sudden, petitioner appeared caught hold her and attempted to commit rape with her after putting her down on the ground. It is further alleged that blouse, sari etc. also got torn and petitioner snatched Rs.2500/-.

No.3740 of 2017 (2) dt.09-02-2017 From the written report itself it appears that general and omnibus allegation has been leveled against this petitioner that he attempted to commit illegal act with the informant. There is no recovery of any amount from the possession of petitioner, whereas informant alleged that he snatched Rs.2500/-. The petitioner is said to be in custody since 22.11.2016.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st Class, Udakishunganj, District-Madhepura in connection with Bihariganj P.S. Case No.166 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Arvind/- U T
