JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2015 The petitioner is apprehending his arrest in a case registered under sections 341, 323, 324, 354, 379 and 504/34 of the Indian Penal Code.
It is alleged that in a fair the informant objected the petitioner and other accused persons including 10-15 unknown persons for teasing the girls whereupon the informant was assaulted and when Jai Prakash Kumar came to his rescue he was also
Patna High Court Cr.Misc. No.51786 of 2014 (2) dt.07-01-2015 2 / 2 assaulted. It is further alleged that the accused persons took away Rs.1600/- from the pocket of Jai Prakash Kumar. It has been submitted by the learned counsel for the petitioner that the accusation is omnibus and general and the injuries are superficial in nature. The petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be enlarged on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Bairginia P.S. Case No. 72 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
