The sole petitioner, who is in custody since 22.07.2016 in Ara Mufassil P.S. Case No.343/2015 registered for the offence under Section 290 of the Indian Penal Code and Section 47(A) of the Bihar Excise Act, has prayed for grant of bail.

By way of referring to the seizure memo, it was submitted by learned counsel for the petitioner that 210 bottles of country-made liquor, containing 200 ml. each, were shown to be recovered from the house of Madhuri Kunwar wife of Late Binod Kumar and the petitioner was made accused along with Madhuri Kunwar showing that they fled away. According to learned

Patna High Court Cr.Misc. No.45723 of 2016 (2) dt.22-10-2016 2/2 counsel for the petitioner, the petitioner has sufficiently remained in custody. He submits that the petitioner is having clean antecedent and this fact has been stated in paragraph-3 of the petition.

Keeping in view the nature of accusation, clean antecedent of the petitioner and period of custody, let the petitioner, namely, Hari Kishun Singh be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Mufassil P.S. Case No.343 of 2015.
