JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 16-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

There was theft in the house of Mukesh Kumar Verma and for that FIR was registered against unknown. During course of investigation, the police traced out complicity of Rakesh Kumar @ Chhotu as well as Prince Kumar and further booty was recovered from the house of Rakesh Kumar @ Chhotu. However, it is further evident that petitioner has associated himself with Rakesh Kumar @ Chhotu up to shop of a goldsmith where they have sold one 'paya'l and in token thereof, he got remuneration. Moreover, for that petitioner happens to be under custody since 23.10.2016 having no criminal antecedent.

Accordingly, petitioner Abdul Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten

Patna High Court Cr.Misc. No.52090 of 2016 (3) dt.16-02-2017 thousand) with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Bhojpur at Ara in connection with Piro P.S. Case No.313 of 2016.
