Petitioners, already in custody, seek bail in connection with Beldaur PS Case No.60 of 2017, registered under Sections 302/34 of the Indian Penal Code.
Allegation in brief is that the accused persons asked the mother-in-law of the informant to go away from the field, they slapped and pushed her as a result she fell down and became unconscious, she was brought to the doctor and declared dead.
Learned counsel for the petitioners submits that there is no specific allegation of assault that who slapped the deceased and apparently no injury was found in the postmortem and cause
Patna High Court Cr.Misc. No.25909 of 2018(3) dt.07-05-2018 2/2 of death too was not ascertained, another accused Bijo Singh was admitted to bail by a co-ordinate Bench of this Court vide Cr. Misc. No.926 of 2018 on 02.02.2018, moreover the petitioners have clean antecedent.
Having considered the aforesaid facts and circumstances, petitioners, namely, Binod Singh and Sunil Singh are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ADJ-Ist, Khagaria in connection with Beldaur PS Case No.60 of 2017.
