1. Heard learned counsel for the petitioners and learned counsel for the State.

2. The petitioners apprehend their arrest in connection with Gardanibagh P.S. Case No. 297 of 2023 registered under Sections 30(a)/34 of the Bihar Excise Act.

3. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to local politics. Further submission is that on perusal of seizure list, it appears that the recovery of the illicit liquor has been made from the beneath of Chitkohra bridge which is an abandon place. It is further submitted that nothing has been recovered from the conscious

4. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bonds each to the satisfaction of Special Judge, Excise Act, Patna in connection with Gardanibagh P.S. Case No. 297 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
