JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.
The prosecution case as per the written report of the informant Rajnish Kumar is that the co villager of the informant namely Jays Raut, Raj Mangal Raut, Ravi Kumar and Vikky Kumar resorted to firing on the father of the informant who subsequently during treatment succumbed to the injury. The petitioner is not named in the FIR, his name subsequently sprang up during investigation.
It is submitted by the learned counsel for the petitioner that the petitioner has maliciously been roped in the present case. Considering the fact that there is specific accusation

No.30165 of 2015 (2) dt.29-07-2015 2/2 of causing fire arm injury against the FIR named accused persons and name of the petitioner subsequently sprang up, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sikrahana at Motihari, East Champaran in connection with Dhaka P.S. Case No.88 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
