The petitioner no.1 is apprehending his arrest in a case instituted under Sections 148, 341, 323, 324, 307, 504, 34 of the Indian Penal Code.

The allegation against the petitioner no.1 is that he fired by gun causing bullet injury in the legs of the informant. It is further alleged that the petitioner took out Rs. 30,000/- from the pocket of the informant.

It has been submitted on behalf of petitioner no.1 that it is a case and counter case. Prior to the institution of the present case, counter case was instituted by the daughter-in-law of

Patna High Court Cr.Misc. No.27611 of 2015 (3) dt.24-09-2015 2/2 the petitioner and to save their skin, they have come up with the present case. Further, from perusal of injury report, it appears that all injuries are simple in nature.

On behalf of the State and the informant, it has been submitted that the petitioner no.1 is named in the FIR. Considering the aforesaid facts, let the above named petitioner no.1 (Ramdayal Pandey), in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Santosh Kumar Jha, learned J.M., 1st Class, Muzaffarpur in connection with Hathauri P.S.Case No. 15 of 2012, subject to the conditions as laid down u/s 438(2) Cr.P.C. (Sudhir Singh, J) singh/- U T
