The petitioner seeks bail in Siwaipatti P.S. Case No. 123/2016, instituted for the offence under Section(s) 366A and 34 of the Indian Penal Code.

It is alleged that this petitioner has kidnapped the daughter of the informant with intention to marry with her. The case diary has been received, wherein the statement of the victim girl was recorded under Section 164 Cr.P.C. in para 39. The victim girl in her statement under Section 164 Cr.P.C. disclosed her age to be 17 years. She stated in her statement that she was taken by Sonu Kumar along with his friend Ahmad and she lived with Sonu Kumar in Delhi for one year. She became pregnant. She also

Patna High Court Cr.Misc. No.8115 of 2017 (3) dt.21-03-2017 2/2 performed court marriage with Sonu Kumar. Thereafter, she was recovered by the police in Muzaffarpur.

From perusal of the statement of the victim girl recorded under Section 164 Cr.P.C., it appears that she was living with this petitioner for more than one year and she also became pregnant and performed court marriage.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX, Muzaffarpur in connection with Siwaipatti P.S. Case No. 123/2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
