The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379, 504/34 of the Indian Penal Code. It is alleged that the accused persons along with the petitioners abusing the wife of the informant, on protest being made, co-accused Samajit assaulted with fist on the mouth of the informant causing injury on the upper lip, co-accused Tenni Yadav assaulted on the head of the informant with iron rod whereas these petitioners also assaulted the informant with iron rod and 'lathi'.
It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.22504 of 2015 (2) dt.22-05-2015 2/2 that the injury of the informant was found to be simple superficial in nature. There is counter version of the occurrence also and the petitioners' side received injuries on the parietal regions. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur (Tehta) P.S. Case No. 17 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
