20-10-2016 Heard Sri Bipin Kumar, learned counsel for the petitioner and Sri Rajesh Kumar, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 10-07-2016 in connection with C-1 Case No. 217 of 2016 registered for offence under Section 47(A) and (F) of the Bihar Excise Amendment Act, 2016, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that on false accusation of recovery of 5 litres of country-made liquor as well as 10 litres of raw materials for manufacturing liquor, the petitioner has been apprehended and languishing in jail. He submits that petitioner is having clean antecedent and this fact has been stated in paragraph - 3 of the petition.
Patna High Court Cr.Misc. No.43130 of 2016 (2) dt.20-10-2016 2/2 Learned Addl. Public Prosecutor has opposed the prayer for grant of bail.
However, keeping in view the nature of accusation, period of custody and clean antecedent of the petitioner, let the petitioner namely Mahendra Kisku be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with C-1 Case No. 217 of 2016.
