JUSTICE SANJAY PRIYA ORAL ORDER 2/ 02-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The Petitioners seek bail in Buxar (Muffasil) P.S. Case No.312 of 2016 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Section 30(a) of Bihar Prohibition & Excise Act, 2016.

It is alleged that both the petitioners are ladies. They are in custody since 08.12.2016 having no criminal antecedents. It is alleged that 48 bottles country made liquor of 200 ML each and 40 bottles of another brand country made liquor was recovered from the possession of petitioner No.1. From the petitioner No.2, 42 bottles country made liquor of 200 ML each and 52 bottles of 200 ML each of another brand country made

Patna High Court Cr.Misc. No.7865 of 2017 (2) dt.02-03-2017 2/2 liquor was recovered.

Keeping in view the period spent by the petitioners in custody, prayer of the petitioners for grant of bail is allowed. Let the Petitioners, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the ACJM V, Buxar, in connection with Buxar (Muffasil) P.S. Case No.312 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioners.

Both the petitioner will file Affidavit in the Court below that they will not indulge in such activities in future, otherwise, their bail bonds would be liable to be cancelled. (Sanjay Priya, J) JA/- U T
