JUSTICE BIRENDRA KUMAR ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner, learned counsel for the Opposite Party No.2 and learned Additional Public Prosecutor for the State.
Petitioner is languishing in custody for the offences punishable under Sections 341/323/498A of the Indian Penal Code.
The petitioner is husband of Opposite Party No.2. It is a case under Section 498A of the Indian Penal Code. Petitioner has stated on oath that he is willing for restoration of conjugal life. Petitioner is in custody since 23.08.2016.
Considering the aforesaid facts, let petitioner,
Patna High Court Cr.Misc. No.8621 of 2017 (2) dt.01-03-2017 2/2 above named, be enlarged on provisional bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi/Successor Court, in connection with Runnisaidpur P.S. Case No. 284 of 2016.
Thereafter the Court-below shall take effort for reconciliation. The order has been passed in presence of learned counsel for the petitioner as well as learned counsel for Opposite Party No.2, hence, no fresh notice is needed. If the Court-below would found that the petitioner is fully cooperative and willing for restoration of conjugal life, the Court-below shall confirm the provisional bail of the petitioner and if otherwise the Court-below shall be at liberty to not confirm the provisional bail.
