JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Kadamkuan P.S. Case No.279 of 2020 for the offence under Sections 25(1-B)A, 26, 27 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is a student of Shivam Convent, Patna Bypass and he is in custody since 03.07.2020. In fact, petitioner had gone to the Lodge to meet with his friends where Birthday party was being organized and as such he has been falsely implicated in the present case.

Considering the fact that the petitioner is in custody since 03.07.2020, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on

No.37175 of 2020(2) dt.02-02-2021 2/2 furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Kadamkuan P.S. Case No.279 of 2020, subject to the condition that both bailors should be teachers of the said Shivam Convent, Patna Bypass.
