The matter has been taken up through video conferencing.
The petitioner seeks bail in Hajipur Town PS Case No. 475/2019 registered under Section 395 of the Indian Penal Code.
The informant alleged that 10-11 persons having armed with different weapons came to Nishad Gas Agency and the accused persons looted away more than Rs. 16 Lakhs from the Almirah of Gas Agency.
The learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of petitioner surfaced in the case in the confessional statement of co-accused,
Patna High Court CR. MISC. No.37002 of 2020(5) dt.25-06-2021 2/2 Abhishek. Nothing has been recovered from the possession of the petitioner. One stolen mobile is said to have been recovered from the possession of Sanjeet Choudhary, who has already been granted bail. The petitioner has not been put in T.I. parade although he is in custody for about ten months. Having considered the facts that name of the petitioner surfaced in the case during the course of investigation in the confessional statement of co-accused, Abhishek, but the police did not recover any looted article from the possession of the petitioner nor the petitioner was put in T.I. parade, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- ( rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town PS Case No. 475/2019.
