The petitioner, invoking writ jurisdiction of this Court under Article 226 of the Constitution of India, has prayed for directing the Respondents to pay Rs.20, 00,000/- as damage on the plea that the confiscation order, whereby the truck of the petitioner was confiscated, has already been set aside by the revisional authority passed in Revision Case no.11/2013. Learned counsel for the petitioner submits that the revisional authority had noticed that the Department has not established the violation of provisions of the Forest Act. On this plea, the compensation has been sought for.
Patna High Court CWJC No.21868 of 2014 (4) dt.28-09-2015 2/2 The Court is of the opinion that in the writ jurisdiction such dispute may not be adjudicated. The writ petition stands dismissed.
