Petitioner seeks bail in a case registered under sections 399, 402 of the Indian Penal Code and sections 25 (I-B)a, 26,35 of the Arms Act.

Petitioner and four others were caught by the informant and other police officials while he and others had assembled to make preparation for committing dacoity.

One country made loaded pistol is said to have been recovered from the conscious possession of the petitioner whereas nothing was recovered from other apprehended accused. No doubt, petitioner does not have any criminal antecedent but he is in jail custody since 18.6.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
